Terms of Service

Carefully read these terms and conditions, as they form a legal agreement between Own Web Now Corp and Customer.
All Payments To Own Web Now Corp Are Non-Refundable

Agreement Overview & Scope

Own Web Now Corp (“The Company”) agrees to furnish services to the Customer, subject to the following Terms of Service (TOS).

By accepting these Terms, Customer agrees to be bound by all of the terms and conditions contained herein and in the Acceptable Use Policy (AUP), Service Level Agreement (SLA), Privacy Policy, and Data Destruction Policy. If you are an individual entering into this agreement on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind such entity to these terms. If you do not agree to these terms, please cease using our services immediately.

Governing Law & Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any legal actions arising out of or relating to this Agreement will be venued exclusively in Orange County, Florida.

Key Terms & Obligations

Disclosure to Law Enforcement
The AUP prohibits illegal use of our services. Subscriber agrees that the Company may disclose any and all Subscriber information including assigned IP numbers, account history, and account use to any law enforcement agency without further consent or notification upon lawful request by such agency.

Service Rates
Subscriber acknowledges that the nature of the service provided and the initial rates and charges have been communicated. The Company may change the rates from time to time with prior written notice. Minimum billing is $30/month. If a Subscriber is late more than twice within a 6-month period, the Company reserves the right to terminate the account.

Payment and Billing
Establishment of this service is dependent upon receipt of payment. All billing is done monthly, with payment due on the 1st of each month. Credit cards are charged automatically. Accounts unpaid by due date are subject to a $15 late fee. Service interruption due to nonpayment requires a reconnect charge. Delinquent accounts sent to collections will incur an additional 25% collection fee and possible administrative fees. All payments are non-refundable.

Non-Payment & Cancellation
The Company reserves the right to deny service or terminate service for non-payment. Cancellations must be submitted in writing with at least 7 days notice. All services are subject to the non-refundable terms.

Service Interruptions & Liability
Customer understands that service may be interrupted for maintenance, upgrades, or failures. The Company shall not be liable for any loss or damage resulting from such interruptions. The Company’s liability shall not exceed the amount paid for services during the affected period. The Company shall not be liable for any consequential damages.

Warranty Disclaimer & Indemnification

Services are provided "as is" without warranty of any kind. The Company disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

Customer agrees to indemnify and hold harmless Own Web Now Corp from any claims, damages, or losses resulting from breach of these terms.

Acceptable Use & Enforcement

Unsolicited Commercial Email & SPAM Policy
The Company maintains a zero-tolerance policy for SPAM. Any violation may result in immediate suspension or termination of services, and the imposition of administrative fees.

Network Security & Prohibited Activity
Customer may not use the service to engage in activities that violate network security, including but not limited to unauthorized access, probing, scanning, spoofing, or flooding. The Company may investigate and report such violations to law enforcement.

Other Terms & Miscellaneous

Intellectual Property & Feedback License
Customer acknowledges that all intellectual property rights remain with Own Web Now Corp. Suggestions or feedback provided by Customer are licensed to the Company.

Hardware / Client Equipment
Customer is responsible for ensuring that their software and hardware are compatible with the services provided. This includes applying updates, patches, and proper configurations.

Assignment & Waiver
Customer may not assign or transfer this agreement. The failure of the Company to enforce any provision shall not constitute a waiver of that provision.

Severability & Entire Agreement
If any provision of this agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect. This agreement constitutes the entire agreement between the parties.
